1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website, services, and platform operated by Tremblay Education Inc. ("Tremblay Education," "we," "us," or "our"), accessible at tremblayeducation.com (the "Platform").

By accessing or using our Platform and services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Platform or services. These Terms apply to all visitors, users, students, and others who access or use our Platform.

2. Description of Services

Tremblay Education provides educational consulting services to international students seeking to study in Canada. Our services include, but are not limited to:

  • University and program matching based on your academic profile and preferences
  • Application preparation, review, and submission assistance
  • Document preparation, collection, and review services
  • Visa and immigration support through licensed professionals
  • Scholarship identification and application guidance
  • Pre-departure orientation and arrival support coordination
  • Ongoing student support and advisory services

Our services are provided to students at no cost. We are compensated by our partner universities and institutions when a student we have counselled enrolls in their programs. This model does not influence our recommendations - we always prioritize the student's best interests.

3. User Accounts

To access certain features of our Platform, you may be required to create a user account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Immediately notify us if you discover any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, incomplete, or in violation of these Terms.

4. Acceptable Use

You agree not to use our Platform or services to:

  • Submit false, misleading, or fraudulent information in applications or documents
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Platform's operation or servers
  • Attempt to gain unauthorized access to any portion of the Platform or user accounts
  • Collect or harvest personal information of other users without consent
  • Use the Platform for any unlawful purpose or in violation of any applicable laws
  • Transmit any viruses, malware, or other harmful code

5. Intellectual Property

The Platform and its entire contents, features, and functionality - including but not limited to all information, software, source code, text, displays, images, graphics, photographs, video, audio, design, presentation, selection, and arrangement - are owned by Tremblay Education, its licensors, or other providers of such material, and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use. This license does not include the right to modify, reproduce, distribute, or create derivative works from our content without our express written permission.

6. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. While we strive to provide accurate and helpful guidance, we make the following important disclaimers:

  • No Guarantee of Admission: We do not guarantee admission to any university or program. Admission decisions are made solely by the institutions.
  • No Guarantee of Visa Approval: While we maintain a high approval rate, we do not guarantee that any visa application will be approved. Visa decisions are made by immigration authorities.
  • No Legal Advice: While our team includes licensed immigration professionals, information provided through our Platform should not be considered formal legal advice. For specific legal matters, please consult directly with our licensed lawyers.
  • Accuracy of Information: While we strive to keep program information, requirements, and deadlines accurate and up to date, we cannot guarantee that all information is current at all times. University policies and immigration regulations may change without notice.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Tremblay Education Inc., its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) our Platform or services
  • Any conduct or content of any third party on our Platform
  • Any content obtained from our Platform
  • Unauthorized access, use, or alteration of your transmissions or content
  • Decisions made by universities, immigration authorities, or other third parties

In no event shall our total liability to you for all claims arising out of or relating to these Terms exceed CAD $100.

8. Indemnification

You agree to defend, indemnify, and hold harmless Tremblay Education Inc. and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements including legal fees arising from or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another party. We reserve the right to assume exclusive defense of any matter subject to indemnification by you.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation is unsuccessful, disputes shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.

10. Termination

We reserve the right to terminate or suspend your access to our Platform and services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

11. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Platform or services after any changes to the Terms constitutes acceptance of those changes.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tremblay Education regarding the use of our Platform and services. These Terms supersede any prior agreements or understandings, whether written or oral, relating to their subject matter.
